Terms & Conditions

Introduction

Welcome to our website. By accessing and using this website, you agree to comply with and be bound by these Terms and Conditions.

These Terms and Conditions apply to international wholesale orders of live plants, including ornamental plants and tissue culture plants.

If you do not agree with any part of these terms, please do not place an order or use our services.

1. Goods & Payment

Our products are live plants supplied for export purposes.

All plants are carefully selected, prepared, inspected, and packed for international transportation.

Orders will be processed and shipped only after full payment has been received and confirmed by the Seller.

By placing an order, the Buyer confirms that the information provided, including shipping and contact information, is accurate and complete.

2. Customs Clearance & Delivery

The Seller is responsible for export customs clearance and will provide reasonable assistance with import procedures in the destination country.

The goods will be arranged for direct delivery to the Buyer’s address.

The Buyer agrees to provide any information or documents reasonably required to support import procedures in the destination country.

3. Taxes, Duties & Destination Charges

Any import taxes, customs duties, customs clearance fees, inspection fees, or other additional charges imposed in the destination country under local regulations shall be borne by the Buyer.

Such additional charges are normally not expected to exceed USD 30–50 per package, although the actual amount may vary depending on the destination country and applicable regulations.

Unless otherwise agreed in writing, the Buyer is responsible for all charges imposed by authorities or service providers in the destination country.

4. Phytosanitary Certificate & Plant Health Documents

A Phytosanitary Certificate or other relevant plant health documents will be provided if requested by the Buyer and agreed upon with the Seller in advance.

The Buyer must inform the Seller of any specific import documentation requirements before placing or confirming the order.

5. Order & Shipment Updates

The Seller will regularly provide the Buyer with reasonable updates regarding the plants and order status, including, where applicable:

  • Export eligibility
  • Actual plant photos
  • Packing status
  • Shipping status
  • Tracking information

The Seller will cooperate with the Buyer to facilitate the export and delivery process.

6. Plant Inspection Upon Delivery

The Buyer must inspect and confirm the condition of the plants within 24 hours of receiving the shipment.

After this 24-hour period, the plants will be considered to have been received in satisfactory condition.

7. Damaged or Dead Plants

If any plants are damaged or dead upon arrival, the Buyer must notify the Seller and provide clear photos and/or videos as evidence within 24 hours of receiving the shipment.

After reviewing the evidence, the Seller will replace the affected plants with:

  • The same plants, if available; or
  • Plants of equivalent value if the original plants are unavailable.

Replacement is the applicable remedy for plants that arrive damaged or dead.

8. No Refunds or Returns

Because the products are live plants and may be affected by transportation time, temperature, weather, environmental conditions, and phytosanitary requirements, all international live plant orders are non-refundable and non-returnable.

For plants that arrive damaged or dead, the applicable remedy is replacement in accordance with Section 7.

No return of live plants will be accepted unless otherwise expressly agreed in writing by the Seller.

9. Customs Delays & Force Majeure

A shipment may be held, delayed, or may not be successfully completed due to customs authorities, phytosanitary inspections, import restrictions, war, natural disasters, fire, accidents, severe weather, transportation disruptions, or other circumstances beyond the reasonable control of either party.

If the plants cannot be successfully delivered due to such circumstances, the order may be resent when conditions permit.

Any related loss or additional costs arising from such circumstances will be shared equally (50/50) between the Seller and the Buyer.

10. Plant Import Regulations

The Buyer is responsible for understanding and complying with the plant import regulations of the destination country before placing an order.

The Buyer should verify whether an import permit, Phytosanitary Certificate, plant health documents, inspection, or other authorization is required.

The Seller will provide reasonable assistance with export and import-related procedures but cannot guarantee the decision of customs, quarantine, or other authorities in the destination country.

11. Live Plant Condition Notice

The Buyer acknowledges that live plants are biological products.

Transportation time, weather conditions, temperature, handling, and phytosanitary regulations in the destination country may affect the condition of the plants and the delivery process.

Both parties agree to cooperate and provide reasonable assistance to ensure that the export and delivery process is completed as smoothly as possible.

12. Declaration of Origin

The Seller certifies that the information provided in the relevant documents and order is true and accurate.

The goods supplied under these Terms and Conditions are of Vietnamese origin.
